Drumgenius — End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Projazzlab, Torino, Italy (“we”, “our”, “us”), the developer of the “Drumgenius” mobile application (“the App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with this Agreement and Google Play’s Terms of Service.

2. Ownership

The App, including but not limited to its software, source code, user interface, the MetroGenius metronome engine, and the drum loop audio library (500+ jazz drum loops), is owned by Projazzlab and is protected by copyright and other intellectual property laws. This Agreement does not grant you any ownership rights in the App or its content — only a license to use it as described above.

3. Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the App, in whole or in part, except where such restriction is prohibited by applicable law
• Extract, copy, redistribute, sell, sublicense, or otherwise make available the App’s audio content (drum loops) outside of the App, in whole or in part
• Modify, patch, or create derivative works of the App, including bypassing or circumventing its purchase/entitlement system
• Distribute, rent, lease, or sublicense the App or any modified version of it through channels other than the official Google Play Store

4. In-App Purchases

The App offers optional in-app purchases (Monthly Pass and Lifetime Access) processed through Google Play Billing. Purchases are subject to Google Play’s own terms and refund policies. We do not process payments directly and hold no payment information.

5. User Recordings

Audio recordings you create using the “My Recordings” feature remain your own content, stored exclusively on your device. We claim no ownership over recordings you make using the App.

6. Disclaimer of Warranty

The App is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Projazzlab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App.

8. Termination

This Agreement is effective until terminated. We may terminate it at any time if you fail to comply with its terms. Upon termination, you must stop using the App and uninstall it from your device.

9. Governing Law

This Agreement is governed by the laws of Italy, without regard to its conflict of law principles.
